Bankruptcy and Debtor/Creditor


Description:

This is a basic course in debtor/creditor law with primary emphasis on bankruptcy. The course includes with an overview of the general principles of state law relating to the recovery of debt, focusing on the distinction between secured and unsecured debt and the relative rights of debtors and creditors.

Most of the course is devoted to a study of federal bankruptcy law. Students are provided with a broad exposure to general principles of bankruptcy law, which allows them to understand not only the substantive legal rules, but also the structure of the bankruptcy system and the policy goals that it seeks to achieve. Because bankruptcy law is statutory, our studies center on the Bankruptcy Code, supplemented by caselaw, and discussed in class through the medium of problems. Students are evaluated by means of a final examination and class participation.

Note: Prof. Blum’s class, when offered, is evaluated by an exam that contains essay questions and multiple choice.
