Oregon Pleading and Practice

A detailed examination of the Oregon Rules of Civil Procedure. Oregon is a code pleading jurisdiction, unlike the federal system. This course entails the application of the ORCP's with the Uniform Trial Court Rules, selected statutes, and conventions to the drafting of pleadings and documents that must be filed to prosecute or defend civil claims in the Oregon courts. Combination of lecture, discussion, and drafting exercises. Students draft complaints, answers, and other court documents in order to learn the art and skill of the complete practitioner. Drafting exercises can satisfy the B writing requirement. The requisites of personal and subject matter jurisdiction will be examined. Students will also be taught the rules and methods of service, discovery, and other steps of practice. Designed for the student who intends to practice in Oregon. Grade will be based on drafting exercises, and mid-semester and final examination.
