Environmental Liability Insurance Seminar*
Description:
Seminar participants examine and discuss the rights and obligations of policyholders and insurers in the context of insurance coverage claims arising out of environmental contamination. Topics include an overview of the sources and nature of environmental liability; types of policies; the development and structure of the standard form comprehensive general liability ("CGL") insurance policy; the terms of the CGL policy's insuring agreement; the duty to defend and duty to indemnify; key exclusions and conditions such as the qualified and absolute pollution exclusions, the owned property exclusion, and the known-loss exclusion, and notice/tender of claim; claims against excess and reinsurance carriers; and litigation and settlement of insurance coverage claims. Students receive grades based on class participation, a client letter, and a final paper and two short-written projects. *Typically offered every other year
