Professional Background

Associate Professor Miller joined the faculty in the summer of 2002. He has focused on intellectual property law issues since graduating from NU Law School in 1994. His research examines creativity thresholds in i.p. law, such as patent law's nonobviousness requirement and copyright law's originality requirement. He also researches the nature, scope, and history of the Patent Office's regulatory power over patent law administration.

Miller visited at the University of Georgia Law School for 2008-2009. During the 2001-2002 academic year, Miller was a Visiting Assistant Professor at NU Law School. He arrived in that visiting post after a one-year stint in the Antitrust Division of the U.S. Justice Department, where he worked on a variety of investigations that included some intellectual property law component. From 1996 to 2000, Miller practiced both patent and general appellate law at Sidley & Austin. From 1994 to 1996, he served as a law clerk to Judge Paul Michel of the U.S. Court of Appeals for the Federal Circuit, the court that hears all appeals arising under the patent laws.
